Terms of Service for SpeakSummarize

1. Acceptance of Terms
By downloading, installing, or using SpeakSummarize (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.
2. Description of Service
SpeakSummarize is an AI-powered voice recording and transcription application featuring Echo, your calm AI memory companion, that:
- Records audio on your device with real-time waveform visualization
- Transcribes recordings using OpenAI Whisper with speaker diarization
- Generates structured AI summaries with key insights, action items, and topics
- Provides AI chat functionality with Echo using Retrieval Augmented Generation (RAG)
- Enables semantic search across all your recordings
- Supports multiple independent chat conversations
- Exports summaries as beautifully formatted PDFs
3. Subscription Terms
Free Plan
- 3 voice recordings (lifetime limit, not monthly)
- Basic transcription and summarization
- Access to core features including:
- OpenAI Whisper transcription
- AI-generated structured summaries
- Local storage of recordings
- Basic chat with Echo (limited)
Premium Subscription (“Premium”)
Premium unlocks unlimited usage and advanced features:
- Unlimited recordings (no limit)
- Unlimited AI chat with Echo across all your recordings
- Multi-chat support (create multiple independent conversations)
- Speaker diarization (identifies different speakers)
- Advanced features:
- Chapters and timestamps
- Entity extraction (people, places, organizations)
- Sentiment analysis
- Topic detection
- Follow-up recording linking
- PDF export with full structured data
- Priority processing
- All future premium features
Pricing
- Monthly: $4.99 USD per month
- Yearly: $49.99 USD per year (save 17% - equivalent to $4.17/month)
- 7-day free trial for new subscribers (yearly plan only)
- Prices may vary by region and are displayed in your local currency in the App Store
Auto-Renewal
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions anytime in iOS Settings > [Your Name] > Subscriptions
- Renewal rate is the same as the initial subscription price unless otherwise notified
Cancellation & Refunds
- You may cancel your subscription anytime through iOS Settings > Subscriptions
- Cancellation takes effect at the end of the current billing period
- You will retain premium access until the end of the paid period
- No refunds for partial months or unused time
- Refund requests must be made directly to Apple via the App Store
Free Trial (Yearly Plan Only)
- New subscribers to the yearly plan receive a 7-day free trial
- You can cancel anytime during the trial without being charged
- If not canceled before the trial ends, you will be automatically charged the yearly subscription price
- Only one free trial per Apple ID
- Monthly subscriptions do not include a free trial
4. User Responsibilities
You agree to:
- Use the App lawfully and ethically
- Not record others without consent (follow local laws)
- Not use the App for illegal activities
- Maintain the confidentiality of your device and data
- Not attempt to reverse engineer or hack the App
5. Data and Privacy
- Audio files and full transcriptions are stored locally on your device
- Audio is processed through our secure CloudFlare Worker proxy to third-party AI services
- Vector embeddings are stored in Pinecone (anonymized, device-specific)
- Echo’s conversation memories are stored in Mem0 (anonymized, device-specific)
- No personal information required - no account, email, or phone number needed

- You are responsible for backing up your data - we recommend periodic PDF exports
- Deleting the app removes all local data; use “Clear All Data” to also remove cloud data
6. Third-Party AI Services
The App integrates with the following third-party services:
OpenAI
- Used for transcription (Whisper API) and AI features (GPT-4o-mini)
- Subject to OpenAI’s Terms of Use and policies
- OpenAI does not use your data to train models (API terms)
Pinecone
- Stores vector embeddings for semantic search
- Subject to Pinecone’s Terms of Service
- Data is anonymized and device-specific
Mem0
- Stores Echo’s conversation insights for personalized assistance
- Subject to Mem0’s Terms of Service
- Memories are user-specific and anonymous
CloudFlare Workers
- Securely proxies API requests without exposing keys
- Subject to CloudFlare’s Terms of Service
Important: We are not responsible for service interruptions, changes to features, or pricing changes from third-party providers. API availability may vary based on provider status.
7. Limitations and Disclaimers
We strive for accuracy and reliability, but you acknowledge that:
Technical Limitations
- Transcriptions may contain errors - accuracy depends on audio quality, accents, background noise, etc.
- AI summaries are automated - may be incomplete, contain inaccuracies, or miss important details
- Speaker detection is not perfect - may misidentify or fail to distinguish speakers
- Internet connection required - most features require active internet connectivity
- Processing time varies - depends on recording length and API response times
Service Availability
- Rate limits apply to free tier users (3 recordings total)
- API quotas may affect service availability
- Downtime may occur for maintenance or third-party service issues
- Feature changes may happen as we improve the app
No Guarantee
- We do not guarantee uninterrupted access
- We do not guarantee 100% accurate transcriptions or summaries
- Echo’s responses are AI-generated and may contain errors
- Search results may not always be relevant
Use at Your Own Risk: The App is provided for personal productivity and should not be relied upon for critical, legal, medical, or safety-related purposes.
8. Intellectual Property
- You retain ownership of your recordings and content
- We do not claim rights to your recordings
- The App’s code, design, and features are our property
- You may not copy, modify, or distribute the App
9. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.
11. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of the App or violation of these Terms.
12. Termination
We reserve the right to:
- Suspend or terminate your access for violations
- Discontinue the App at any time
- Modify features or pricing with notice
13. Changes to Terms
We may update these Terms from time to time. Continued use after changes constitutes acceptance of new Terms.
14. Recording Consent Laws
YOU ARE RESPONSIBLE for complying with all applicable laws regarding audio recording and consent:
- Some jurisdictions require all-party consent before recording conversations
- Some jurisdictions allow one-party consent (only your consent required)
- You are solely responsible for obtaining necessary consents before recording others
- We disclaim all liability for your use of recordings in violation of applicable laws
- Do not use the App to record others without their knowledge and consent where required by law
15. Export Controls
You agree to comply with all export and import laws and restrictions. The App may not be exported or re-exported to certain countries or persons prohibited under applicable laws.
16. Governing Law & Disputes
Jurisdiction
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law provisions.
Dispute Resolution
- Informal Resolution: Please contact us first to resolve any disputes informally
- Arbitration: Any disputes will be resolved through binding arbitration per the American Arbitration Association rules
- Class Action Waiver: You waive the right to participate in class action lawsuits
- Small Claims: You may bring claims in small claims court if eligible
Exceptions
The above does not apply to:
- Intellectual property disputes
- Claims that cannot be arbitrated under applicable law

18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
19. No Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
20. Assignment
You may not assign or transfer these Terms without our consent. We may assign these Terms to any affiliate or successor without restriction.
21. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and us regarding the App. They supersede any prior agreements or understandings.
22. Apple-Specific Terms
App Store Requirements
This App is available through the Apple App Store and subject to Apple’s Licensed Application End User License Agreement (EULA).
Apple’s Role
- Apple is not responsible for the App, its content, maintenance, or support
- Apple has no warranty obligations for the App
- Apple is not responsible for addressing claims relating to the App
- Apple is a third-party beneficiary of these Terms and may enforce them
Device Requirements
- Requires iOS 17.0 or later
- Compatible with iPhone and iPad
- Internet connection required for AI features
Acceptance
By downloading, installing, or using SpeakSummarize, you acknowledge that you have:
- Read and understood these Terms of Service in their entirety
- Read and understood our Privacy Policy
- Agreed to be bound by both documents
- Understood that premium features require a paid subscription
- Accepted all limitations, disclaimers, and risks outlined above
If you do not agree to these Terms, do not use the App.
